This is unfortunately not true (either the Minister got bad advice or he is wilfully lying). Section 1(1)(b)(iv) of the Commissions Act empowers the President to make regulations “providing generally for all matters which he considers it necessary or expedient to prescribe for the purposes of the investigation.” This is a blank discretion allowing the President to do anything he wishes regarding a Commission of Inquiry. It means the President is empowered to authorise state funding for lawyers for those affected by the Commission.
